New South Wales law provides special benefits to the children who are injured in motor vehicle accidents. To be eligible for such special benefits, the child concerned should however be below the age of 16. In addition, the child should be a resident of New South Wales. The benefits provided include financial assistance for medical expenses, rehabilitation expenses, respite care and attendant care, and such other expenses. Children’s special benefits can be claimed irrespective of the fault of the child. However, if it becomes clear that the accident was somebody else’s fault, the injured child may be able to recover personal injury compensation as well, in addition to the special benefits.
