Although in the 18th and 19th centuries English courts were reluctant to apply duty of care where the plaintiff and defendant were not in privity to each other, the importance of expanding the concept of duty of care to cover the new situations created by the industrial revolution was soon felt. As a result, the concept of duty of care gained a new momentum in the early 20th century and the courts started to readily apply the concept even where the plaintiff and defendant were separated by vast distances of space and time. As a result, duty of care is now applied in a variety of situations, ranging from medical negligence to product liability.
