My question involves an injury that occurred in the state of: Arizona
I was in a classic red light rear end accident in March of this year when my girlfriend was driving. The following day of the accident we both went to the hospital (emergency room) due to back and neck pain only to be told by the staff that they could not help us, we should just wait it out. That's when we called Phillips Law and was advised to see a chiropractor and that they would start immediately on preparing our case if permitted. Needless to say we let the attorney take the case as they had a near perfect customer service record on Yahoo. That same week we started the four month long chiropractor visit that totaled 29 visits.
The offer presented today by Phillips Law is $7,700 from StateFarm Insurance (my claim only). Let's break that down into numbers:
$4,100 for chiropractor
$2,000 for hospital and misc. prescriptions
Total I owe is $6,100
$321.71 out of pocket for gasoline (I drive a full size truck and live in the country)
$100 emergency room co-pay
$10 co-pay on prescriptions
Total out of pocket is $431.71
Attorney fee is 33.33% (high for the area, however Phillips was highly rated)
Based on the $7,700 offer we get numbers like the following:
7700 - 33.33% = 5133.59 to my claim (attorney takes 2566.41)
I pay out $966.41 to cover my debt
I lose $431.71 from out of pocket expenses
Total amount of money I lost will be $1398.12
Phillips Law did inform me that the first offer is always low and they will decline with my permission and press for a higher number. My paralegal as stated he was going to get with the chiropractors office to arrange a lower pay off along with the hospital. Needless to say I declined the first offer.
Is something wrong here or is this normal. I was expecting enough to at least cover my medical bills and some extra for pain and suffering. Not a black hole of pure loss...
