I and my ex have a child together. I was forced to leave the child behind when we brokeup with a parenting plan. We live interstate and I travel to spend time with my child every month. Recently I negotiate with my ex to increase my contact time but my ex refused. My ex also convinces me to make parenting plan as a consent order claiming that I changed my mind often so my ex needs some sort of security. I tried to negotiate but my ex refused and wants to keep consent order as it says in parenting plan.
My solicitor suggested me not to sign anything. I showed her parenting plan and there is no anything about child support. My solicitor said my ex might try to claim child support from me at some stage.
My questions;
1. My ex runs own business and reports individual tax at very low while me working for a company, where any sort of income will be reported. I tried online assessment and found I have to pay 100% of the cost (25% care) which I could not afford because I have to pay for travel and accommodation to see my child every month. Can I get my travel costs taken into account?
2. My ex also claims family tax benefit. Is it considered as my ex's income or not?
3. Can my ex stop me from seeing my child if I refuse to sign consent order?
4. My ex treatens me if I don't sign, this matter could end up in court. Is it possible to get 50/50 care where both parents live different states? I feel like I am in disadvantage as court might award the child lives with my ex, and leave me to see less of my child and pay 100% child support.
