Product Liability Claims
The four main ways in which a manufacturer can be found to be at fault in a product liability claim are:
1. Manufacturing
If contamination has occurred in a factory or a batch of products has been damaged during the manufacturing process and the quality control procedure has not identified this and you have suffered injury as a result, the manufacturer is likely to be liable.
2. Design
If a product is poorly designed, such as a toy that has very sharp edges or a kettle that allows steam to escape around the handle, and you have sustained an injury as a result, you can make a product liability claim against the manufacturer.
3. Warnings
If a manufacturer fails to exhibit sufficient warnings on a product that is inherently dangerous, such as an electrical appliance, or a salesman has downplayed the warnings on such an item, then the company may well be found to be liable if you are injured as a result.
4. Failure to recall/announce warnings
If a manufacturer discovers a problem with a product that could cause personal injury and fails to announce warnings about the product and injury occurs as a result, a product liability claim could well be successful, if you are injured by the product.

Product liability claims are claims resulting from accidents caused by goods or products which have been supplied or work which has been carried out.
The types of accident which could result from defects in products are numerous and the following are some examples :-
- Fire or injury resulting from faulty electrical goods
- Injuries caused by by defective tools, knives and sharp or dangerous objects, etc
- Road accidents caused by defective parts or faulty workmanship during repair or servicing
- Food poisoning
- Damage to teeth by foreign bodies in food
- Injuries to children by unsafe toys
- Products may cause accidents for a variety of reasons - defective materials or workmanship, defects in design, inadequate or misleading warnings or instructions, defective containers or packaging.
Product Liability Compensation
Anyone manufacturing or selling goods or carrying out work (eg. building work, repair work) may find themselves responsible to pay compensation to consumers injured by their products. Such liability may be at Common Law or under Statute eg. the Sale Of Goods Act and the Consumer Protection Act have provisions specifically intended to make it less difficult for injured consumers to claim against suppliers of defective products.

If a business supplies products to consumers then they need to make sure those products are safe. Normally the responsibility falls square on the shoulders of the actual manufacturer of any product found to be defective. A manufacturer or producer can be a company that actually makes products, one that imports a product into this country or even businesses that customise other manufacturers products for their own stores. But stores and other retailers i.e. distributors also have responsibilities pertaining to the products that they sell on.

Product liability compensation claims fall into four main categories which are :-
Defective Design :-
The product is inherently dangerous as a result of poor or inadequate design. Whilst some designs are clearly inadequate others can produce complex and difficult legal argument particularly in high value in product liability compensation claims.
Defective Manufacture :-
This is usually as a result of a quality control failure when a product or batch does not conform to the usual specification. Manufacturers are "strictly liable" in some product liability compensation claims as a result of defective manufacture and an injured consumer may, in certain circumstances, find it unnecessary to prove that they were negligent.
Defective Warnings :-
Are the warnings accurate and up to date and does the product information accurately reflect any dangers or risks associated with the product, or have they been contradicted by statements in advertising or made by sales representatives?
Negligent Surveillance :-
Companies must respond adequately when inherent defects come to light, subsequent to sale of the product, to warn consumers about the product's lack of safety. This may involve personal contact by letter or phone, advertisements in the press and other media and bill boards or A boards outside the retailers shop or premises.

What are the hazards?

What are the defects?
Airbag inflator: As it gets older, a combination of high temperatures and humidity can cause the airbag inflator propellant to degrade. If an affected vehicle is involved in a collision triggering the airbag, the metal inflator housing may explode/rupture under too much internal pressure.
What are the hazards?
In the event that a defective airbag inflator ruptures, metal fragments may propel out through the airbag cushion towards the vehicle occupants causing serious injury or fatality. If you are involved in a collision, the airbag may go off with too much explosive force causing sharp metal fragments to shoot out and kill or seriously injure people in the vehicle.
What should consumers do?
Owners of affected vehicles should contact their local Mercedes-Benz dealership or Mercedes-Benz head office directly via the website at https://www.dealerlocator.mercedes-benz.com.au to arrange for a replacement airbag inflator free of charge.

What are the defects?
In some circumstances water entry into the boat's fuel tank may occur via the breather holes.
What are the hazards?
If water enters the engine's fuel system via the boat's fuel tank it is possible the engine could shut down. This could occur while the boat is being operated, meaning the boat may not be able to return to port, increasing the risk of a boating accident and/or injury to the boat occupants.
What should consumers do?
Affected owners should immediately stop operating the boat and engine and contact their nearest authorised Quintrex, Stacer or Savage dealer to arrange for an inspection of the fuel tank and for a fuel filler spacer to be installed.

What are the hazards?
Damage to the outer coating of the tablets may affect the release rate or dosage of the medicine.
What should consumers do?
Check your Jurnista packaging to see if you have any tablets from batch number IALS400. If so, check the blister packs and tablets for any signs of damage (do not remove tablets from the packaging unless they are going to be consumed straight away). If the blister pack or tablets are damaged do not consume them. Return the entire Jurnista box to your dispensing pharmacy to discuss replacement options.
In the likely event that the blister pack and tablets are not damaged, you should continue to take the medication as prescribed by your doctor.

You might not experience any physical signs of high blood sugar levels and only be able to detect it in your blood sugar measurements.
If you experience any signs or symptoms of hyperglycaemia while using a NovoPen Echo insulin cartridge holder, measure your blood sugar levels as instructed by your health professional and take appropriate action. Contact your health professional for further advice.
If you have a device from an affected batch, register your details (name, address, phone number, email and number of affected cartridge holders) at http://www.novonordisk.com.au/ to arrange to receive a replacement NovoPen Echo insulin cartridge holder for each of your affected devices (after approximately 7 working days).
NovoPen Echo insulin cartridge holders should always be cleaned in accordance with the instructions in the User Guide. Only a dampened cloth should be used to clean your device. Using a cracked or broken insulin cartridge holder could result in the device delivering a smaller dose of insulin than expected, which can lead to serious health consequences including hyperglycaemia (high blood sugar).
What should consumers do?
If you or someone you provide care for uses NovoPen Echo insulin cartridge holders, check the batch numbers on any devices you have to see if they are affected by this recall.
If you have a device from an affected batch and it is not currently loaded with an insulin cartridge, stop using it and replace the cartridge holder in accordance with the User Guide as soon as possible.
If the device is currently loaded with an insulin cartridge, replace the cartridge holder in accordance with the User Guide the next time you load a new insulin cartridge.
Do not stop insulin treatment without consulting with your health professional.
Be aware of signs and symptoms of hyperglycaemia. Symptoms normally come on gradually and can include:
- feeling flushed
- dry skin
- feeling sleepy or tired
- dry mouth
- 'fruity' breath
- urinating more often
- feeling thirsty
- losing your appetite
- nausea/vomiting.
You might not experience any physical signs of high blood sugar levels and only be able to detect it in your blood sugar measurements.
If you experience any signs or symptoms of hyperglycaemia while using a NovoPen Echo insulin cartridge holder, measure your blood sugar levels as instructed by your health professional and take appropriate action. Contact your health professional for further advice.
If you have a device from an affected batch, register your details (name, address, phone number, email and number of affected cartridge holders) at http://www.novonordisk.com.au/ to arrange to receive a replacement NovoPen Echo insulin cartridge holder for each of your affected devices (after approximately 7 working days).
NovoPen Echo insulin cartridge holders should always be cleaned in accordance with the instructions in the User Guide. Only a dampened cloth should be used to clean your device. Bleaching agents such as chlorine, iodine and alcohol should not be used when cleaning NovoPen Echo insulin cartridge holders. Cracking and breaking should not occur if the device is cleaned in accordance with the instructions in the User Guide.
There are no reported problems with the insulin being administered by these devices.

Product Liability compensation claims
When a manufacturer releases a product to market they have a duty to ensure that the product is safe for use by consumers. If a product is unsafe, whether by virtue of its manufacture, composition, unsuitability for use, or because of inadequate instructions (amongst others), then the manufacturer, designer or sometimes the distributor will be liable for that fault.

In the past, it was necessary to show that the manufacturer is the one to blame for the defect and to prove that they were at fault. However, it is now possible for anyone injured by a product to make a claim, regardless of whether they were the original purchaser or not. Further there is now no requirement to prove the negligence of the manufacturer at any stage. This is how product liability claims differ from other personal injury claims, as other claims require there to have been some negligent act or omission on the part of the defendant in order to make a successful claim.
What Are Products?
‘Products’ for the purposes of product liability claims also include food and drink produce. Other products include consumer goods, pharmaceutical products and ‘bio-medical’ products, which are devices implanted into humans e.g. hip replacements, breast implants and pacemakers.
Product liability claims typically fall into four distinct categories. These are:
Manufacturing faults; in which the product is defective as a result of something that occurred, or failed to occur during the manufacturing process.
Failure adequately to warn; a product does not supply the consumer with any or adequate warnings about the correct or safe use of the product. This can include instructions, information on packaging and information in advertisements.
Design faults; although the product may be manufactured exactly to specifications there is a problem or fault with the design. Because of this, the product is inherently dangerous.
Negligent Surveillance; this is when a manufacturer, on learning that one or more of its products is faulty, fails to warn consumers about the problem with its products – either by issuing inadequate warnings or by not issuing warnings at all.
It is important to note that defective products are not merely of poor quality; indeed there are a number of issues that a court will consider when determining product liability claims.
Multi-Party Claims
Although each product liability claim is different, there are some situations in which many people are injured in the same or similar ways by the same defect. In these circumstances, there may be a multi-party action with many people all suing the manufacturer for injury caused by their defective products. If this happens, it is common for a solicitor’s firm to take on multiple clients who all have the same or similar claims.
Proving Product Liability
In product liability claims the court will consider all the circumstances of the case, including the way in which the product was advertised and marketed to consumers, the warnings and cautions supplied with it and the intended purpose of the product, as well as the time when the product was supplied to the recipient. However, some cases are provable on a strict liability basis. In these cases, there is no need to prove negligence: the mere fact that the manufacturer supplied the product is enough to prove liability. This is the case with e.g. pharmaceutical drugs.
