In New South Wales, the Work and Safety Act 2011, which replaced the occupational heath and safety laws, is the applicable piece of legislation when it comes to the workplace safety and health standards. According to Section 7 of the new Act, “the worker is a person who carries out work in any capacity for another person conducting a business or undertaking, including an employee, a contractor, a sub contractor, an employee of a contractor or subcontractor, an employee of a labour hire company, an outwork, an apprentice, a trainee, a student gaining work experience and a volunteer.” Section 8 of the Act states that a work place is “a place where the work is carried out for a business or undertaking and includes anyplace where a worker goes, or is likely to be while at work.” The Act imposes certain duties upon the worker, such as taking reasonable care for their own health and safety, taking reasonable care for heath and safety of others, complying with any reasonable instruction by employers, and cooperating with any reasonable policies and procedures of the employers. In addition, the employers and workers need to comply with “Managing the Work Environment and Facilities; Code of practice” which is applicable to all type of work and workplaces which are covered by the Work and Safety Act. The aim of the code is to educate the parties involved on how to keep a working environment which is free of heath and safety risks. The code has provisions for physical work environments, facilities for workers, such as toilets, drinking water, washing and dining, personal storage, remote and isolated work and emergency plans.
