I have been married for almost 20 years (married in South Africa) and, for the past 20 months my husband has been having an inappropriate relationship with a colleague at work. He doesn't mistreat me, is very affectionate, takes me on holidays but can't see how this "friendship" is tearing me apart. Despite all of the above, we do not have a physical relationship - his excuse is he has no interest whatsoever.
I have a host of physical health problems as well as being treated for clinical depression. The only skill I had was as a para legal in Sth Africa and have not worked in 7 years. We are both Australian citizens. As a result of having a severe stroke, I am unable to type sufficiently well to obtain employment in my chosen field, nor is my short term memory good enough to carry me in a position of my choosing. I am now 48 and have been told by various drs and a psychiatrist that working is not an option for me at this point in time.
I love my husband but cannot continue living with 3 people in this marriage. My questions are:
1 Is there a legal separation in this country; and
2 If so, would I be entitled to spousal support; and
3 would I be able to sue the 3rd party for alienatIon of affection.
IN the event of the above ?s being in the negative, would the fact that:
1 we sleep in the same bed;
2 vacation together;
3 socialise together,
count as being separated for 12 months (even though we are not physically active).
