At common law, duty of care arises in a situation where one individual or group engages in an activity which may potentially harm another. Harm can be physical, mental or economical. For instance, if a pedestrian is injured due a person’s negligent driving the injured person may be able sue the driver for negligence. Also if a person suffers a financial loss due to a mistake of an accountant the accountant may be sued for negligence. However, if an individual has not created the situation that caused harm to the other, the former cannot be held liable for the latter’s injuries.
