Duty of care in English Law is a legal obligation on an individual or group which requires them to exercise reasonable care when performing activities which may foreaseeably harm others. However, it is important to note that for duty of care to exist, the individual or group should have created the situation which causes the harm to another. For instance, a driver who injures a pedestrian by negligently operating the vehicle or an accountant cause a financial loss to his client by erroneously preparing the accounts themselves create the situation where the other party is injured. But duty of care does not arise when a passerby fails to rescue another person who is drowning in a river, for the reason that the situation passerby is by no means responsible for the situation which cause harm to the other.
