This course offers a survey of employment law. We will explore the relationship between the employer and employee and their respective rights, duties and legal obligations. The course will cover how the common law and state and federal statutes regulate the workplace. We will cover such subjects as the establishment of the employment relationship and the doctrine of "at will" employment, employee versus independent contractor status, tort and contract theories of employer liability to employees, state and federal wage/hour laws and class action litigation, "family rights" in the workplace, workplace safety, trade secrets and unfair competition, and emerging issues such as privacy rights in the workplace, the impact of social media and alternative dispute resolution.
