One of the main things that a patient seeking to recover compensation from a dentist for dental negligence must prove is that the dentist failed to take standard care of the patient. In other words, the method of care used by the dentist should have fallen below the standard care. But what the standard care expected from a dentist is difficult to determine. Generally, standard care in medical negligence law is the care that would be provided by a competent medical practitioner in the defendant’s circumstances. Therefore, in dental negligence cases too, the patient may have to refer to other dentists’ opinions as regards the proper method of care in the circumstances to determine the standard care expected from the dentist in question.
