A claim on product liability may be based on one or more of four different theories. These theories are negligence, misrepresentation, breach of warranty and strict tort liability. Negligence is a situation where one party fails to take reasonable steps to avoid foreseeable harm that can be caused to another by the first party’s acts or omissions. Breach of warranty is a situation where the seller fails to fulfill the terms of a promise, claim or representation he has made with regards to the quality or nature of the product. Misrepresentation is a situation where the seller while advertising or promoting the product gives false security to the user regarding the safety of the product. In strict liability, the seller or manufacturer will be held liable for the injury caused by the defective product irrespective of their guilt.
