The military justice system is a generic term which covers functions such as discipline in the Australian Defence Force (ADF), administrative action to support ADF policy, inquiries to establish facts relevant to operation and command of the ADF, and the provisions for review and management of complaints.
The system is essential to ADF operational effectiveness and it complies with Commonwealth laws. Military members are subject to the same laws as apply to other Australians. The military justice system applies to all ranks. All ADF members have an interest in the success of the system.

In 1982 the Federal Government introduced the Defence Force Discipline Act 1982 (DFDA) as a part of Commonwealth law. This law became effective in 1985, and all ADF members are subject to it.
The purpose of the DFDA is to maintain and enforce military discipline.
The discipline system is necessary for ADF operational capability by dealing with offences that affect military discipline. This includes offences that are uniquely military and other offences that occur in a military environment.
Offences by ADF members are prosecuted under the DFDA, within the military justice system, when the offence substantially affects the maintenance and ability to enforce Service discipline in the ADF. Otherwise, criminal offences or other illegal conduct are referred to civil authorities, such as the police.
The military justice system provides the ADF with an Australian legal framework able to be applied on operations anywhere in the world. This is essential because the ADF may conduct operations in countries where the civil system has broken down and no law applies.
The military justice system applies to all ADF members in times of peace and war, whether in Australia or overseas. ADF members must maintain the high level of discipline required on operations, at all times.
The discipline system includes processes for the investigation of alleged offences, preferring of charges and conduct of fair and reasonable trials.
All ADF members have access to free legal advice in the internal discipline system. This is unique to the military.
The discipline system includes safeguards such as automatic review of convictions and punishments and the right to an internal and external appeal. These safeguards are more extensive and rigorous than those available in the civilian criminal system.
Administrative system
The ADF is not the only working environment where an individual's inappropriate behaviour could lead to the death or injury of a colleague.
Like many other organisations the ADF has an administrative system to support its operations. The system includes components that allow the ADF to maintain the expected standard of professional judgement, command and leadership.
The administrative system also includes provisions to inquire into the facts of any matter.
The administrative system is intended to ensure operational effectiveness. It is not a substitute for punishment for an offence under the discipline system.
Adverse administrative action
A high standard of professional conduct is expected of all ADF members. If professional conduct falls below standard, administrative action is taken.
Administrative action includes counselling, formal warnings, censures, removal from command, and discharge from service.
Redress of grievance and other complaints
The ADF is proud of its progressive system of redress and complaints, which is among the most comprehensive anywhere.
The administrative system includes a legally protected redress of grievance provision that allows an individual to complain about any matter that affects his or her service. The ADF provides legal assistance to ADF members who wish to make a complaint.
There are a number of internal and external organisations to assist ADF members in making a redress or complaint. Usually members submit redress or other complaints through their commanding officer or chain of command. If this course of action is not appropriate then members are able to seek other avenues for complaints.

Internal organisations for dealing with complaints include:
• Fairness and Resolution Branch, and

• the Office of the Federal Privacy Commissioner.
In some cases, members may also seek a review of the administrative conduct or decisions, made in the ADF, by the Federal Court and higher courts.
Administrative inquiries
The administrative inquiry process is not part of the discipline system. There are different types of administrative inquiries, such as Boards of Inquiry and Investigating Officer Inquiries.
An administrative inquiry determines the facts of an event. By determining what went wrong, the ADF is able to initiate reforms that maintain operational effectiveness, prevent a reoccurrence and save lives.
An administrative inquiry is an internal process that does not place blame and incriminate members involved for offences under the discipline system.
It is important that witnesses are able to give evidence to an inquiry without fear of disciplinary action arising from their admissions. Without this, it might not be possible to get to the true causes of an incident. Openness and frankness are important to a successful inquiry.
Administrative inquiries can be conducted by either ADF personnel or civilians. A civilian may be appointed to be on a Board of Inquiry, or to be an inquiry officer.
The reports resulting from an inquiry are generally not available to the public because of privacy and security obligations. In some cases, such as reports from Boards of Inquiry and Investigating Officer Inquiries, legislation also requires Ministerial approval for public or other release of inquiry reports. These legal protections are necessary to encourage openness and frankness in the inquiry process to enable the true facts to be determined.
Administrative inquiries are essential in maintaining ADF operational effectiveness and ensuring the safety of ADF members. They are used to identify faults and improve ADF systems, procedures, training and equipment. Getting to the facts of the matter and initiating reforms is essential to ADF effectiveness.

Americas BAE Systems Controls Inc., based in Endicott, New York, has received a contract modification to repair the KC-135 Stratotanker’s fuel management panel and integrated fuel management computer. This fixed-price modification increases the total contract value from $5.2 million to $7.6 million and extends the contract term. The work will continue in Endicott, New York, with completion expected by March 14, 2026. Currently, no additional funds are being allocated for this extension. Tinker Air Force Base in Oklahoma oversees the contracting activities. Raytheon Co. has been awarded an $18.5 million contract modification for the Evolved SeaSparrow Missile (ESSM) and NATO SeaSparrow Missile Systems programs. This cost-plus-fixed-fee modification extends Raytheon’s involvement in providing engineering and technical services for these advanced missile systems. The total value of the modification is $18,468,273. Work will be performed primarily in Tucson, Arizona, accounting for 73% of the effort, with 26% conducted in Portsmouth, Rhode Island, and the remaining 1% at various other locations. Americas Anduril has clinched a $642-million contract to supply counter-drone technology for the US Marine Corps (USMC). Under the 10-year deal, the defense tech company will install, deliver, and sustain installation-counter small unmanned aircraft systems and related services to USMC bases worldwide starting this year through 2035. The California-based firm bested nine other unnamed competitors in the solicitation issued in February last year. It is expected to provide a network of defenses to detect, track, identify, and defeat small drones and other threats against USMC installations and personnel. The US Air Force 53rd Test and Evaluation Group’s Detachment 3 recently conducted an operational taxi test at Nellis Air Force Base, Nevada, successfully integrating a US Navy AGM-84 Harpoon missile system onto an F-16 fighter. Americas Rockwell Collins Simulation and Training Solutions won a $15 million modification, which exercises options for the Delta Software System Configuration-5 retrofit effort of Weapons Systems Trainer (WST)-1 and WST-2, to include associated training, technical data, computer software, and computer software documentation for each WST in support of the E-2D Hawkeye Integrated Training Systems for the Navy. Work will be performed in Point Mugu, California and is expected to be completed in September 2027. Naval Air Warfare Center Training Systems Division, Orlando, Florida, is the contracting activity. The Canadian military has announced plans to acquire new helicopters to respond to potential crashes involving the F-35 fifth-generation fighter jets in the Arctic. (click to view full) Northrop Grumman’s E-2C Hawkeye is a carrier-capable “mini-AWACS” aircraft, designed to give long-range warning of incoming aerial threats. Secondary roles include strike command and control, land and maritime surveillance, search and rescue, communications relay, and even civil air traffic control during emergencies. E-2C Hawkeyes began replacing previous Hawkeye versions in 1973. They fly from USN and French carriers, from land bases in the militaries of Egypt, Japan, Mexico, and Taiwan; and in a drug interdiction role for the US Naval Reserve. Over 200 Hawkeyes have been produced. The $17.5 billion E-2D Advanced Hawkeye program aims to build 75 new aircraft with significant radar, engine, and electronics upgrades in order to deal with a world of stealthier cruise missiles, saturation attacks, and a growing need for ground surveillance as well as aerial scans. This marks a significant upgrade for the brigade, which is part of the Pennsylvania National Guard and the first reserve component Stryker unit. B-52H: flyin’ low, dyin’ slow… (click to view full) Officially, it’s the B-52H Stratofortress. Unofficially, it’s the BUFF (Big Ugly Fat F–cker). Either way, this subsonic heavy bomber remains the mainstay of the U.S. strategic fleet after more than 50 years of service. A total of 102 B-52H bombers were delivered from FY 1961-1963, and 94 were still on the books as of May 2009, flying mostly from Barksdale AFB, LA and Minot AFB, ND. Of these, 18 are slated for retirement, leaving a planned fleet of 76. By the time that fleet retires in the 2030s, many will be around 70 years old. The B-52H can’t be flown against heavy enemy air defenses, but a steady array of upgrades have kept the aircraft relevant to follow-on strikes and current wars, where its long time on station and precision weapons have made the BUFF beautiful. Americas Collins Aerospace, a company based in Cedar Rapids, Iowa, has won a contract worth about $80 million to create a new avionics system for the Army’s H-60M helicopters. Sikorsky’s $8.5-11.7B “Multi-Year 8” H-60 Helicopter Contract

US Army HH-60Ms (click to view full) In July 2012, the US military signed another huge contract with Sikorsky. With production of the Army’s HH/UH-60M, and the Navy’s MH-60S and MH-60R helicopters, all in full swing, there’s no question about the need for future orders. In that environment, multi-year contracts allow efficiencies in purchasing, and security of staffing, throughout Sikorsky’s supply chain. These new helicopter types are also available to Foreign Military Sales class customers, under the American contract’s advantageous pricing and terms. The UH-60M, MH-60S and MH-60R models have already inked export deals, and official requests indicate that more deals are in the pipeline. The new multi-year 2013-2017 contract could be worth up to $11.7 billion, and follows a 5-year, multi-service “MYP-VII” contract in December 2007. But the helicopters are wearing out. Fast. The pace demanded by the Global War on Terror is relentless, and usage rates are 3 times normal. Attrition is taking its toll. Over the past few years, CH-53s have been recalled from “boneyard” storage at Davis-Monthan AFB in Tucson, AZ, in order to maintain fleet numbers in the face of recent losses and forced retirements. Now, there are no flyable spares left. Enter the Heavy Lift Replacement (HLR) program, now known as the CH-53K. It aims to offer notable performance improvements over the CH-53E, in a similar airframe. Since 1956, over 40 models and variants have served as the tactical airlift backbone for over 50 nations. The C-130J looks similar, but the number of changes almost makes it a new aircraft. Those changes also created issues; the program has been the focus of a great deal of controversy in America – and even of a full program restructuring in 2006. Some early concerns from critics were put to rest when the C-130J demonstrated in-theater performance on the front lines that was a major improvement over its C-130E/H predecessors. A valid follow-on question might be: does it break the bottleneck limitations that have hobbled a number of multi-billion dollar US Army vehicle development programs?
