It must be understood that in many cases Legal Aid NSW requires an applicant granted legal aid to pay a short share based on their income and assets. However, the applicant does not have to pay a short factor when they may take place in Local Court criminal matters, except for committals, matters where a plea of not guilty has been entered or matters requiring expenditure. In this case, Murphy J granted the wife’s application for a declaration that a section 90B financial agreement, that is, an agreement made before relationship, made in 2004 was not binding on the basis that she had not been given the necessity legal advice. While the provisions of the Act which applied at that time differ somewhat to now, legal advice was still needed to be given and this case highlights the importance of making a record of the advice offered. Murphy J discovered that the wife’s solicitor’s recall of the advice given was ‘significantly reduced in respect of essential areas of the matter’.

Draft case-studies were organized and a copy then presented to each participant by mail. A time was prepared to help participants to discuss any concerns and recommend changes. Each ultimate ‘draft case study’was given approval by individuals. The names of the individuals and family members were changed, as was other key identifying information, to protect their confidentiality. A high-level of settlement of money was expected by VLA despite there being no real advantage gained from property cases. Tough instances including those described here were taken into account under the prior legal aid system.
