My question involves an injury that occurred in the state of: MA
Back in June, I was driving to work and stopped at a red light when my car bumped the one in front of me. I had been preparing to go at the green light when my foot slid off the brake and my car rolled forward.
The woman in the car immediately turned to look back at me, lept out of the car, and began screaming about needing to go to the emergency room and how she was a nurse. Then she called the police. She then proceeded to berate me while we inspected both cars to find no damage.
After the officer came and asked her to calm down and sit in her car, she forced him to call an ambulance (he was reluctant) and she was taken away in it. I then filled out and mailed the crash report and called my auto insurance to report the accident.
That's all I've heard for six months, until on Saturday I got a letter telling me that her claims would likely exceed my policy limit ($40,000 minimum in MA, not sure how much I have) and that I should get a lawyer.
I've been entirely stressed since then. I know all the advice will be to call my insurance rep and get a lawyer, and that's exactly what I plan to do first thing tomorrow morning, but any peace of mind you could lend me until then will be vastly appreciated.
As a note, my biggest worry is not what she would get if she sued me (21 year old college student with no job) but what she could do to my parents. I was driving my mom's car at the time (I'm on the insurance for it) and though my parents don't own a home and make very little, all I can imagine is them taking her retirement that she's been saving for 40 years and garnishing her meager wages.
I just want this horrible woman to go away
