Special Considerations for divorce
• A married couple filing for divorce after less than two years of marriage must, according to the Family Law Act, attend counseling or mediation at an approved agency in order to attempt reconciliation. A special form must be submitted with the divorce application signed by the approved agency, proving counseling was attended, unless extenuating circumstances that make this impossible or inappropriate occur. If the marriage originally occurred overseas but one or both partners are Australian citizens or residents, the couple will also need to include a copy of the marriage certificate and, if the certificate is not in English, a translation, as well as an affidavit from the translator certifying the accuracy of the translation. If one of the parties involved in the divorce is untraceable, the other party can continue the application for the divorce, but must prove that an attempt to contact the spouse was made.
