My husband and I have been married for over 11years have two children aged 8 and 3. He owned a house when we met contributing equity into a new home we built together. He wants to split 50/50 but does not want to pay maintenance or provide any significant care to our kids. I have worked fulltime from day one as well as prime carer of children and home. He receives two pensions equivalent to $77k/year, does not need to work. I earn $60k/yr need to work and care for my children. Because he is in receipt of these pensions he does not have any super as his pension replaces this, yet he wants to make a claim against my super as part of the split. He does not want to be responsible for the youngest as he 'can't handle her', but is willing to tprovide shared care for the older one (boy) . I have endured emotional/physical and pyschological turmoil whilst supporting my husband throughout his medical compensation claims. I have benefitted financially as he has invested his lumpsums into our current property. As he does not want to pay maintenance as in his words 'he won't have any money left for himself to live on', would 60/40 be fair without disavantaging my children too much, with no claim by him on my super and no claim by me of maintenance? He insists that because he had a property before we met that he should get more.
