A Melbourne mother of five, who cannot be named, faces losing her home because her former partner has stopped paying the mortgage as he was ordered to do by the Federal Magistrates Court last August. The woman, whose children, aged six to 22, live at home, said she would have to spend at least another $6000 on legal fees because her original court orders were most likely invalid. The government passed legislation in 2009 that should have given the Family Court the power to deal with property and maintenance disputes between de facto couples. However, as revealed in The Australian last week, it neglected to arrange for the Governor-General to proclaim a start date for the changes, which meant they failed to take effect.
