Hi. I am American recently separated from my Australian husband. We did not sign a pre-nup and unfortunately have not ended our relationship amicably. I have inherited a large sum of money from my mother passing away in America. According to Illinois USA state law, separate property is anything you owned prior to the marriage or a gift or inheritance after the marriage that was given only to you. So that means that in Illinois any inheritance that you received before or after the marriage would be just yours, not marital property; therefore, it would go only to you during the divorce. Is this still valid in Australia. My question is will I have to split my inheritance with my ex? Is there anything I can do to protect myself even though we don't' have a pre-nup.
He hasn't worked in four year bc he simply doesn't want to and I have paid his way during our entire relationship. and I recently found out after we split that he has been lying to Centrelink to get more money and working, and doing illegal things for money on the side.
Any advice or suggestions would be greatly appreciated. Thanks so much for your time.
