Breach of warranty refers to a situation where the seller fails to fulfill the terms of a promise, claim or representation he has made with regards to the quality or the nature of the product. The buyer purchases the product relying on such promise, claim or representation and as a result, the buyer suffers a loss or damage due to the seller’s failure to fulfill it. The law assumes that there are certain implied warranties in every sale of goods contract. The seller can be made liable for breach of such implied warranties as well.
