In a product liability case, the court will have to consider all relevant circumstances including the marketing of the goods, packaging of the goods, warnings and instructions for use and reasonable uses of the goods before making a determination. The court will specially consider the marketing of the goods, packaging of the goods, the warning and instruction for use and what may reasonably be expected to be done with the goods. If a consumer suffers a loss or damage, they should take action within three years of becoming aware of such loss or damage, safety defect of the good or identity of the person who manufactured the goods.
