Like many other personal injury lawsuits, to prevail in a boating accident suit, you need to show how the defendant, the person you would be suing, caused the Florida boat accident by demonstrating lack of care, or negligence. There are many ways a person can be careless on a boat:
* Boating in a restricted area without regard for other boaters or persons, posted speeds, wake restrictions, or diver-down flags
* Improper speed that endangers the life or property of any person or going fast in a posted no-wake zone
* Exceeding maximum loading - weight or number of people -or horsepower as displayed on the capacity plate installed by the vessel manufacturer
* Allowing passengers to ride on the bow, seat backs, or any other place there may be a chance of falling overboard
* Boating while under the influence of alcohol or drugs.
