The plaintiff instituting a medical negligence case against a healthcare provider must establish four elements in their case. First, it must be shown that the healthcare provider owed a duty of care towards the patient in question. Second, it must be shown that the duty was breached. Third, it must be shown that the breach of the duty was the proximate cause of the injury the plaintiff is complaining about. Finally, it must also be shown that the plaintiff suffered damage, either pecuniary or motional, as a result of the death or injury.
