In a medical negligence case, the plaintiff has to prove four elements, namely the duty of care, breach of duty, causation and damage. Of those, the element which is usually difficult to prove is causation. The plaintiff must show that the act or omission of the healthcare provider was the most likely cause of their injuries. But most patients have underlying illnesses and medical conditions, and in most cases it will be extremely difficult to say what the condition of the patient would be, if he did not receive the treatment or care in question.
