During that time the respondent gave her $27,000 towards a purchase of a home, and paid regular payments. Of between $2,000 to $3,000/month till the relationship ended. The applicant argued that they were in a de facto relationship over the 17 years. The respondent argued that it was an affair. The court ruled in favour of the respondent and assessed the relationship on a number of indicia that indicate a public expression of coupledom. It is interesting that the court did not rule out the possibility of defacto relationships existing simultaneously with a marriage or other de facto relationship.
