Margaret E. St. John (2011 J.D. Candidate, Quinnipiac University School of Law) recently published her note entitled The Connecticut Probate Court System Reform: A Step in the Right Direction, 24 Quinnipiac Prob. L.J. 290 (2011). The introduction of the note is below:
For over one hundred and fifty years, the Connecticut Probate Court System remained virtually unchanged, and critics disparaged the system for almost as long. On January 5, 2011, a reform implemented major alterations to all areas of the system. While many believe that the reform was long overdue, others fear it does not correct the shortcomings of the former system.
This Note explores how the reform will affect Connecticut lawyers, judges, and citizens who use the probate courts. Specifically, Section II identifies the benefits and shortcomings of the Connecticut Probate Court System prior to the reform (the “pre-January system”). Section III discusses the details of Connecticut House Bill 6385 and the reform that this Bill effectuated (the “current system”). Section IV examines the New York Surrogate's Court System and compares it with the reformed Connecticut system. Finally, Section V argues that, while the reform did not remedy all of the shortcomings of the former system, it is a step in the right direction for Connecticut Probate.
