Negligence is a situation where one person’s failure to take reasonable care results in injury or loss to another person. Generally, negligence involves four elements. First, the plaintiff must prove that the defendant has a duty of care towards the plaintiff. Second, the plaintiff must show the defendant’s conduct fell behind the standard of care which is expected from a reasonable person in his circumstances. Third, the plaintiff must prove that he suffered injury or loss, which the defendant could reasonably have foreseen as direct outcomes of his conduct. Finally, the plaintiff must establish causation, which means the injury or loss was caused by the defendant’s conduct itself.
