Negligence is one of the four grounds on which a claim for product liability can be based. The other grounds include breach of warranty, misrepresentation and strict liability. In a negligence case, the plaintiff will have to establish that the manufacturer or seller has failed to taken steps to prevent foreseeable harm from being caused to the plaintiff. The plaintiff will have to establish the four elements of an action for negligence, namely duty of care, breach of duty, injury caused and causation.
