Workers compensation legislation in Australia targets to provide economic and other compensation workers injured at work or suffering an illness arising to do the work. Employers must act in accordance with the state, territory legislation which applies to them.
Workers compensation is a legal, no-fault system of compensation for work-related injuries. It is mandatory for the employer to take out workers compensation insurance.
Generally Injury means any mental or any type of physical injury and includes any disease in the course of employment. It also includes the recurrence or pressure of any existing injury or disease and injuries while traveling to and from work.
The employer's legal obligations are set out in the Acts which apply in each State. Broadly, an employer's obligations are to supply a safe and healthy workplace for employees so they are not at danger of any accident or injury because of work practices. If an employee suffers from an injury or disease work-related, the required support and help should be available.
